Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of AITShirt ("we", "us") and our AI T-shirt design generator (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.

2. What the Service does

The Service uses artificial intelligence to turn your text prompts and reference images into digital design files for T-shirts and similar products. It can also remove backgrounds and upscale designs for printing.

• Digital files only. We do not print, sell, ship or fulfil physical products. You are responsible for any printing, production and sale, and for your dealings with print shops and print-on-demand platforms.
• AI results vary. AI output can be unexpected, inaccurate or imperfect: text may be misspelled, details may be distorted, and similar prompts can produce similar results for different users. Check every design, including any text, before you print or sell it.
• Previews are illustrations. Shirt previews and mockups show how a design may look; real colours and sizes depend on the printer, method, fabric and garment colour.
• We may change, add or remove features, models and styles at any time.

3. Your account

You must be at least 13 years old (or the minimum age required where you live) to use the Service, and old enough to form a binding contract to make purchases. Give us accurate information, keep your login details secure, and tell us promptly about any unauthorised use. You are responsible for everything done through your account.

4. Credits, plans and payments

• Credits. Generating designs and running background removal or upscaling uses credits. The number of credits a generation will use is shown before you start. Credits have no cash value, cannot be transferred or exchanged, and can only be used on the Service.
• Expiry. Some credits expire, for example credits included in a subscription period, promotional credits or credits with a stated validity. The expiry date of every credit grant, if any, is shown under Credits in your account.
• Failed generations. If a generation fails or times out, the credits it used are returned to your balance automatically.
• Subscriptions. Subscriptions paid by card renew automatically at the end of each billing period until you cancel. You can cancel at any time in your billing settings; cancellation stops future renewals and your plan stays active until the end of the period you have paid for. Purchases made with Alipay or WeChat Pay cover one period or one pack and do not renew automatically.
• Prices. Prices are shown on our Pricing page and at checkout, together with the currency. We may change prices for future purchases or billing periods; changes to an active subscription take effect from the next renewal, after notice.
• Taxes. Prices may not include taxes, which are added where required.
• Refunds. Refunds are handled under our Refund Policy. When a payment is refunded, the credits it granted are removed from your balance.

5. Your prompts and uploads

You keep whatever rights you have in the prompts, text and images you submit ("Inputs"). You give us a limited licence to host, process and transmit your Inputs, including to our AI model providers, only to run the Service for you. You confirm that you have the rights needed to submit each Input, including any photo of a person, pet, artwork or logo.

6. Your designs and commercial use

• Ownership. As between you and us, the designs the Service generates for you ("Outputs") belong to you, and we assign to you any rights we may have in them. We do not claim ownership of your Outputs and do not use them to train AI models.
• Commercial use. Outputs generated with credits from a paid plan or a purchased credit pack may be used for any lawful commercial purpose, including printing and selling shirts, listing them on print-on-demand platforms and creating work for clients. Outputs generated with free or promotional credits are for personal, non-commercial use.
• No uniqueness guarantee. Other users may receive similar Outputs, and you may not be able to stop them from using theirs.
• Copyright. In some countries, images created mainly by AI may not be protected by copyright, or only in part. We make no promise that you can register or enforce copyright in an Output.
• Your responsibility. Before you sell or publish an Output, it is up to you to check that it does not infringe anyone's rights and that it meets the rules of the platform you sell on.
• Our examples. The sample designs and images shown on our website are for illustration only. They are not licensed to you unless you generate them in your own account.

7. What you may not create or do

Do not use the Service to create, upload or distribute content that:

• uses trademarks, logos, brand names, sports team or school marks, or copyrighted characters, artwork or lyrics that you do not have permission to use;
• uses the name, face or likeness of a real person without their permission, or impersonates someone;
• sexualises minors in any way, or is sexually explicit;
• promotes violence, terrorism, hatred or harassment against people or groups;
• is illegal, deceptive or defamatory, or infringes privacy or publicity rights.

You also may not attempt to bypass credit charges, limits or safety filters; scrape, overload or reverse engineer the Service; resell access to it; or use automated means to access it except through an API we provide for that purpose.

We may block prompts, refuse or remove content, and suspend or close accounts that break these rules.

8. Intellectual property complaints

If you believe content created or stored through the Service infringes your rights, email us with your contact details, a description of the work, the location of the content and a statement that you are the owner or authorised to act for them. We will review every notice and act on it where appropriate, and we close the accounts of repeat infringers.

9. Our service and brand

The Service, its software, website, design, name and logo belong to us or our licensors. Except for your Outputs and Inputs, these Terms do not give you any right to them.

10. Third-party services

The Service relies on third parties, including AI model providers, payment processors and hosting providers. Print shops and print-on-demand platforms you choose to use are independent of us; their own terms apply and we are not responsible for their products or services.

11. Disclaimers

The Service and all Outputs are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and that the Service will be uninterrupted or error-free. Nothing in these Terms removes rights you have as a consumer that cannot be excluded by law.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or printing and production costs. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnity

You agree to defend and indemnify us against claims, losses and costs arising from your Inputs, your use of Outputs, or your breach of these Terms.

14. Ending your use

You may stop using the Service and close your account at any time. We may suspend or close your account if you break these Terms or if we must do so by law. If we close your account for a breach, unused credits are forfeited. If we stop offering the Service entirely, we will give reasonable notice where we can.

15. Changes to these Terms

We may update these Terms. When we do, we will change the date at the top of this page and, for material changes, notify you through the Service or by email before they take effect. If you keep using the Service after that, you accept the updated Terms.
